Introduction:
As a groundbreaking technological trend, Artificial Intelligence (AI) brings about revolutionary changes in virtually all spheres of human life, including the field of law. Traditionally, a lot of effort, extensive documentation, and time were necessary for carrying out research and case management within the framework of legal practice. Thanks to AI-based solutions, the mentioned activities are becoming much easier and faster. Thus, the current paper is focused on analysing the role of AI in legal research and case management, as well as its advantages and disadvantages. Moreover, the future implications of AI in law will be discussed as well.
Impact of AI on Legal Research:
Legal research is one of the time-consuming processes that cannot be neglected. However, AI provides numerous opportunities for making this activity quicker and more efficient. In particular, there are some legal databases and search tools that make use of NLP and machine learning algorithms to process vast amounts of data. Contrary to conventional keyword-based approaches, AI is capable of identifying legal texts based on the analysis of their semantic content and context. Thus, according to Surden (2019), machine learning models allow for classifying texts and recognising certain patterns. Predictive legal analytics is another advantage offered by AI to researchers. By utilizing historical data on past cases, algorithms can effectively predict the probable outcome of a court decision. In fact, Katz (2013) found out that algorithmic models were quite successful when it came to predicting judges' decisions. Moreover, AI allows summarising legal judgments in a timely manner, thus helping lawyers save their time while ensuring better comprehension of the information presented therein. For example, Ashley (2017) states that such features contribute greatly to enhancing the effectiveness of legal research. Nevertheless, the mentioned benefits can also result in some problems. First of all, algorithms produce outputs that rely solely on the quality of the datasets available. As a consequence, bias and other similar issues are possible, and lawyers should take care of this problem. Furthermore, too much dependency on AI solutions could impair the ability of researchers to develop sound arguments and conduct in-depth analyses. This idea was developed by Remus and Levy (2017).
Impact of AI on Case Management:
Case management is yet another area where the application of AI contributes to the optimisation of legal processes. Specifically, it helps automate many activities involved in case management. In fact, e-discovery refers to a common type of activity carried out in the process of managing legal cases. In order to find and analyse evidence, lawyers need to sort through enormous amounts of data. This process can be optimised by using appropriate software. According to Bommarito and Katz (2010), computational techniques can be employed to structure and interpret legal documents. Workflow automation is another benefit provided by AI technology in legal case management. By using certain programs, lawyers can schedule deadlines and track the progress of case management. Consequently, the risks associated with human errors will be reduced, and overall efficiency will be increased. Moreover, automation will help deal with some legal obligations, such as filing documents in accordance with procedural requirements. AI also makes it possible to automatically generate certain legal texts, which saves time for lawyers who have to perform tedious drafting tasks manually. At last, some case management solutions are represented by AI chatbots designed to assist clients. Susskind (2019) claims that this trend enhances the accessibility of legal services due to the reduction of their costs.
Advantages of Using AI in Legal Research and Case
Management:
The following are several main benefits resulting from applying AI technology in the field under discussion: Time savings; Reduced costs; Accurate analysis and interpretation of data; More effective decision-making; Scalability of operations. According to Alarie, Niblett, and Yoon (2018), these advantages stimulate law firms to move towards adopting an evidence-based approach to decision-making.
Challenges and Ethical Issues:
Despite all these advantages, there are several problems
related to the adoption of AI in law. Some of them will be outlined below.
- Algorithmic Bias: The issue under discussion relates to the potential for perpetuating preexisting biases inherent in datasets. As was stated above, AI models depend on input data and may produce biased outputs. Hence, Zalnieriute et al. (2019) consider this challenge as a threat to the implementation of AI.
- Lack of Transparency: This disadvantage stems from the functioning of so-called black-box models of AI, which do not provide clear explanations for their outputs.
- Data Privacy and Protection: Legal data is highly confidential. In addition, the use of AI systems makes it even more vulnerable because of the risks of data leakage and breach.
- Professional Responsibility: Lawyers are responsible for generating sound and reliable legal arguments based on AI outputs. Otherwise, they may be considered guilty of negligence.
- Impact on Employment: Some positions, such as junior lawyers, are potentially threatened by AI because they involve routine activities. Therefore, McGinnis and Pearce (2014) claim that the profession needs to adapt to these changes by developing appropriate skills.
Future Implications:
Future trends associated with the implementation of AI include greater cooperation between humans and AI algorithms. Besides, AI itself will become more advanced, hence providing more effective solutions. For instance, online courts and dispute resolution will become more frequent owing to digitalisation. Additionally, the issue of explainable AI, discussed by Susskind (2019), will attract much attention in the future. Finally, the education system, particularly legal studies, will change in response to the emergence of new opportunities brought about by AI. Indeed, in accordance with Eidenmüller (2020), the latter will become part of legal expertise.
Conclusion:
AI brings numerous benefits to the field of law, improving the processes of legal research and case management. Although there are still some challenges associated with the use of this technology, AI remains an important innovation. Instead of substituting lawyers, AI serves as a helpful instrument for conducting research and managing legal cases.
